Langley & Banack appellate attorneys Sara Murray and Dylan Drummond recently obtained victories in appellate matters challenging the enforceability of an agreement to arbitrate employee injury claims.

In an appeal before the Fifth Court of Appeals in Dallas, Sara and Dylan obtained reversal of a trial court order refusing to refer an employee’s injury claim to arbitration.  The Court of Appeals found that the arbitration provision in an employer’s injury benefit plan was valid and enforceable, and delegated the issue of arbitrability to the arbitrator.

In an earlier mandamus proceeding before the Fifth Court of Appeals, Sara obtained relief for an employer seeking to compel arbitration arising from an employee’s injury claim.  The trial court had ordered a jury trial on the enforceability of an arbitration agreement, but was unclear about whether it had denied a motion to compel arbitration.  The employer sought mandamus relief from the Fifth Court of Appeals, which concluded that the arbitration agreement delegated arbitrability to an arbitrator and directed the trial court to grant the employer’s motion to compel arbitration.
